Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("Customer", "you", or "your") and hostnetvps.com ("Company", "we", "us", or "our"). By creating an account, placing an order, or accessing any services provided by hostnetvps.com, you agree to be bound by these Terms and our related policies, including our Privacy Policy and Service Level Agreement.

Our services are provided exclusively to business and technical customers in authorized jurisdictions including the United States, United Kingdom, Canada, Australia, New Zealand, and European Union member states.

2. Service Scope & 6–8 Hour Hand-Provisioning Guarantee

hostnetvps.com provides done-for-you Virtual Private Server (VPS) instances, high-performance compute nodes, and DGX Spark unified memory attaches.

Hand-Provisioning Commitment: Each server is custom-configured by our infrastructure engineers, including kernel tuning, OS security hardening, firewall configuration, and Docker container runtime installation. Under standard operating conditions, working server credentials will be delivered to your customer portal within 6–8 hours of verified payment.

3. Subscriptions, Invoicing, & Payment Processing

Services are provided on a recurring monthly subscription basis. Payment is processed securely via Stripe. All rates are quoted in United States Dollars (USD) and exclude applicable local taxes unless explicitly noted.

Subscriptions automatically renew each month on the anniversary of initial deployment until explicitly cancelled via the customer portal or billing management interface. Failed payments will trigger automated notifications and a 3-day grace period prior to temporary server suspension.

4. Acceptable Use Policy (AUP)

Customers agree not to use hostnetvps.com compute resources for any prohibited, malicious, or abusive activities, including but not limited to:

  • Unsolicited bulk email delivery (SPAM) or hosting open mail relays.
  • Denial of Service (DoS/DDoS) attacks, network port scanning, or unauthorized penetration testing against third-party networks.
  • Hosting malware, command-and-control infrastructure, phishing pages, or pirated copyright material.
  • Unregulated cryptocurrency mining without prior written authorization from hostnetvps.com operations.
  • Activities violating the laws of the United States, European Union, or Customer's home jurisdiction.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of service without refund.

5. Server Credentials & Customer Security Responsibilities

Upon completion of hand-provisioning, server root credentials and SSH access keys are stored in an encrypted vault using AES-256-GCM encryption. To reveal credentials inside the customer dashboard, customers must undergo password re-authentication.

Customers are solely responsible for maintaining the confidentiality of their account credentials, configuring their own application security layers, and auditing user access. hostnetvps.com logs every credential access event for audit verification.

6. Backup Policy

Backups are managed by our team. Our operations team maintains configuration and system state recovery safeguards to restore server images in the event of underlying hardware failure. Customers remain responsible for maintaining their own external copies of mission-critical production databases and proprietary application data.

7. Service Level Agreement & Pro-Rata Service Credits

hostnetvps.com guarantees 99.9% monthly availability for network connectivity and host compute infrastructure. In the event of unscheduled downtime exceeding the SLA threshold during any calendar month, Customer is eligible for pro-rata service credits as specified in our Service Level Agreement (SLA).

Service credits represent the Customer's sole and exclusive financial remedy for outages or service unavailability.

8. Technical Support Channels

All support inquiries, hardware change requests, and technical assistance must be submitted through the in-dashboard ticket form located at /dashboard/support. We do not provide support via unauthenticated channels such as email, instant messaging apps, or social media direct messages.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall hostnetvps.com, its directors, employees, or infrastructure partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.

Our aggregate liability under this Agreement shall not exceed the total amount paid by Customer to hostnetvps.com during the three (3) months immediately preceding the event giving rise to the claim.

10. Termination

Customer may cancel their subscription at any time through the customer billing portal. Cancellation takes effect at the conclusion of the current monthly billing period. hostnetvps.com reserves the right to suspend or terminate services immediately for non-payment or severe breaches of the Acceptable Use Policy.
